CLASS ACTION WAIVER: WHERE PERMITTED BY APPLICABLE LAW, YOU AND MENLO SECURITY AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THIS MEANS THAT YOU MAY NOT BRING CLAIMS AGAINST MENLO SECURITY AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
